Actor Aayush Shah and his business partner Mausam Shah, co-founders of Maars Communicates PR Agency, have filed multiple complaints in a magistrate court against Akshay Bardapurkar, the founder of the OTT platform Planet Marathi, alleging cheque dishonour under the Negotiable Instruments Act.
The complaints, filed earlier this month, pertain to a series of nine cheques issued by Bardapurkar to the Shah duo, which were dishonoured upon presentation. The total disputed amount is Rs 1,14,30,400, with Rs 87 lakh owed to Aayush Shah and the remainder to Mausam Shah.
According to the complaints, the cheques were issued with the promise of payment, but upon presentation, they were dishonoured due to insufficient funds. Furthermore, a monthly interest of Rs 3,61,500 has been accruing on the unpaid amount since May 2024, significantly increasing the financial liability of the accused.
Aayush Shah has filed three separate complaints against Bardapurkar and Planet Marathi Seller Services, while Mausam Shah has lodged one complaint. Their legal representative, Krishnagopal S. Tripathi, confirmed that the matter involves both criminal complaints under the Negotiable Instruments Act and potential civil litigation for damages and further accountability.
Under the Negotiable Instruments Act, the dishonouring of cheques is a criminal offence, punishable with imprisonment of up to two years, a fine, or both. The Shah duo’s decision to pursue both criminal and civil remedies underscores the seriousness of the allegations and their determination to hold Bardapurkar accountable for the financial default.
The court is expected to hear the matter in due course. Meanwhile, the complainants are preparing to file a civil case seeking damages and additional legal remedies.
This case highlights the growing disputes in the entertainment and media industries over financial transactions and contractual breaches, emphasizing the need for stringent compliance with financial commitments.
