Allahabad, India — In a significant ruling, the Allahabad High Court has directed the Government of Uttar Pradesh to reconsider the regularisation of teachers appointed between 1993 and 1996 in various management colleges across the state. Justice Shree Prakash Singh issued this directive after setting aside previous orders from Regional Level Committees (RLCs) that had declined to regularise these teachers’ services.
The court’s decision came in response to numerous challenges filed by the affected teachers against the RLCs’ decisions. These committees, led by the regional joint director of education, had previously denied the regularisation requests, prompting the teachers to seek judicial intervention.
In his ruling, Justice Singh noted that the RLCs’ decisions appeared to have been made in a “cursory manner,” failing to properly consider the teachers’ long-term service and contributions. The bench observed that many of these educators have been working for over two decades, underscoring the necessity for the state to fulfill its role as a welfare state.
“The state must act as a welfare state to consider their regularisation in accordance with the law after giving them full opportunity of hearing,” Justice Singh emphasized. The court has mandated that the RLCs pass fresh orders within three months, taking into account all relevant legal provisions and ensuring a fair hearing for the teachers involved.
This ruling is seen as a significant step towards securing the employment rights of long-serving educators in the state’s management colleges, providing a pathway to job stability and recognition of their years of service.
