Justice Sameer Jain, while granting bail, noted that the girl had stated in her testimony that she was over 17 years old when the First Information Report (FIR) was lodged and that she had willingly accompanied Alam. The girl also expressed no objection to Alam’s release on bail, according to the lawyer representing her.

The incident dates back to a train journey, where a dispute occurred between Alam and the girl. Following the altercation, a Bajrang Dal member lodged a police complaint, alleging that Alam had kidnapped the girl and forcibly converted her religion. The FIR against Alam included charges under several sections of the Indian Penal Code (IPC), including kidnapping (Section 363), rape (Section 376), and criminal intimidation (Section 506).

Alam was also booked under the Protection of Children from Sexual Offences (POCSO) Act due to the girl’s age at the time of the alleged incident, and the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021, a law designed to prevent forced religious conversions.
