Allahabad High Court Sets Aside Uttar Pradesh Government’s Order Removing DSP; Directs Reinstatement

In a significant verdict, the Allahabad High Court has nullified a 2019 order issued by the Uttar Pradesh State Government, which compulsorily retired a deputy superintendent of police from his post. Ratan Kumar Yadav, the petitioner, had been removed from his position following the recommendation of a screening committee, purportedly to maintain efficiency within the state police service.

Justice Prakash Padia, presiding over the case, allowed the writ petition filed by Yadav, highlighting various irregularities in the process leading to his removal. The court emphasized that the screening committee failed to provide any concrete grounds or subjective satisfaction for the compulsory retirement decision. Moreover, it noted that the committee did not adequately consider Yadav’s individual case or his service record.

The court further criticized the government’s order for compulsory retirement, stating that it not only lacked legal basis but also cast a stigma on Yadav and amounted to double punishment, as it included details of earlier disciplinary actions against him.

Consequently, the High Court declared the state government’s order as unsustainable and contrary to law, thereby quashing it. Additionally, the court directed the state government to issue a fresh order for Yadav’s reinstatement within three weeks.

Yadav, who initially served as a sub-inspector in the Uttar Pradesh Police and later ascended to the position of deputy superintendent of police, can now anticipate his return to duty following this judicial intervention. The ruling underscores the importance of procedural fairness and adherence to legal standards in administrative decisions, particularly those concerning public servants.
