In a significant development, the Punjab government informed the Punjab & Haryana High Court on Friday that the nomination filing process of radical Sikh preacher and NSA detainee Amritpal Singh for the upcoming Lok Sabha elections is being facilitated at Dibrugarh jail in Assam.
Punjab Deputy Advocate General Arjun Sheoran apprised the HC bench of Justice Vinod S Bhardwaj that the documentation process was completed after Amritpal’s lawyers and proposer met him in Dibrugarh jail on May 9. They are now able to submit the nomination papers to the returning officer for the Khadoor Sahib seat, Sheoran informed the court.
These submissions were made during the hearing of a plea filed by Amritpal, the chief of Waris Punjab De, seeking to ensure a smooth process for filing his nomination papers as an Independent candidate. He had also requested temporary release from jail to file his nomination papers.
Amritpal, along with nine others from his outfit, has been behind bars since April 2023 after a crackdown on the Waris Punjab De outfit by the Centre and Punjab. Booked under the National Security Act (NSA), Amritpal was arrested on April 23, 2023, in a Moga village following a month-long chase since his escape on March 18, 2023. Last month, the Punjab government re-invoked NSA against all of them.
According to Sheoran, once the documents are submitted, the superintendent of Central Jail, Dibrugarh, will administer the oath to Amritpal in accordance with the provisions of the law, and the certificate of oath will be submitted to the returning officer. The administration of the oath takes place once the nominations are filed.
The high court has disposed of the plea in view of these submissions, although a detailed order is awaited. This development underscores the efforts to ensure the democratic participation of individuals even under challenging circumstances, while upholding the rule of law and procedural fairness.
