In a significant turn of events, Delhi Chief Minister Arvind Kejriwal has moved the Supreme Court to challenge the Delhi High Court’s recent order, which upheld his arrest in connection with the Liquor Scam case. This move comes in the wake of the High Court’s decision on Tuesday, affirming the legality of Kejriwal’s arrest by the Enforcement Directorate (ED).
The Delhi High Court, in its ruling, justified Kejriwal’s arrest, highlighting his repeated non-compliance with summonses and refusal to cooperate with the investigation. The court maintained that the ED was left with limited recourse given Kejriwal’s persistent avoidance of joining the inquiry.
Dismissing Kejriwal’s plea, the High Court emphasized that his arrest did not violate any legal provisions and could not be deemed “illegal.” The bench further underscored that the timing of the arrest, particularly in relation to general elections, should be assessed in accordance with legal standards rather than political considerations.
“The court further stated that this court is of the opinion that the accused has been arrested and his arrest and remand have to be examined as per law and not as per the timing of elections. Kejriwal’s challenge to the timing of arrest before General elections in the absence of any mala fide on the part of ED is not sustainable,” the HC bench remarked.
Kejriwal’s decision to challenge the Delhi HC’s order in the Supreme Court signals a continuation of the legal battle surrounding the Liquor Scam case. As the case progresses, all eyes will be on the apex court’s deliberations and the subsequent implications for the embattled Chief Minister.
