In a surprising turn of events, BRS MLC Kalvakuntla Kavitha, currently in Enforcement Directorate (ED) custody over the Delhi liquor policy scam case, has withdrawn her 2023 petition challenging the summons issued to her by the Enforcement Directorate before the Supreme Court.
Senior counsel Vikram Chaudhri, representing Kavitha, informed the court on Tuesday that the petitioner had already been arrested, rendering the petition moot. He indicated that Kavitha would file a fresh petition challenging her arrest and remand instead.
This decision diverges from the stance taken on the day of Kavitha’s arrest on March 16, where her counsel had intended to apprise the Supreme Court of alleged violations by the ED. They had planned to initiate contempt of court proceedings against the agency for arresting Kavitha, despite its earlier oral undertaking before the apex court in September, assuring no coercive actions against her.
The case had been adjourned to March 15, during which the ED sought to retract a statement made in September regarding the deferment of summons to Kavitha. However, the court deferred further discussion on the matter to Tuesday.
Amidst this backdrop, Kavitha’s counsel opted to withdraw the petition before the Supreme Court without delving into the aforementioned issues. With the petition deemed infructuous, the bench, led by Justice Bela M. Trivedi, granted permission to withdraw it.
Subsequently, Kavitha filed a fresh petition challenging the legality of her arrest and remand until March 23. The new petition is pending hearing, with Kavitha’s counsel submitting an urgent application before the Registry for its expeditious consideration. The counsel may further mention the matter before the Chief Justice bench on Wednesday for necessary action.
