In a recent ruling, the Calcutta High Court has affirmed that addressing a woman as ‘sweety’ or ‘baby’ is not necessarily indicative of sexual harassment. The assertion came during Justice Sabyasachi Bhattacharyya’s hearing of a case involving a former Coast Guard trainee and her superior.
The court cited relevant sections of the Prevention of Sexual Harassment (POSH) committee to support its stance. While acknowledging that the use of terms like ‘baby’ and ‘sweety’ may be deemed inappropriate by the Internal Complaints Committee, it emphasized that such expressions, prevalent in certain social circles, do not always carry a sexual connotation.
The case revolved around the trainee’s discomfort with her superior’s use of endearing terms. However, upon being informed of her discomfort, the superior ceased using such language, indicating a lack of malicious intent. The Internal Complaints Committee had previously dismissed the case after investigation, a decision upheld by the Calcutta High Court.
Moreover, the court cautioned against the misuse of provisions within the POSH Act, warning that excessive abuse could create additional barriers for women in the workplace. Justice Bhattacharya emphasized that while the statute provides necessary protection against harassment, overzealous enforcement may hinder the advancement of competent and hardworking female professionals.
The ruling underscores the importance of context and intent in determining instances of sexual harassment, while also advocating for a balanced approach to upholding workplace rights and fostering a conducive environment for both men and women.
