“Calcutta High Court Temporarily Exempts Lawyers from Wearing Black Gowns Until June Due to Weather Conditions”

In a significant move aimed at providing relief to legal practitioners amidst rising temperatures, the acting chief justice of the Calcutta High Court, T S Sivagnanam, has announced that lawyers will be exempted from wearing black gowns in courts until June 2023. This decision comes in light of the prevailing weather conditions and the challenges posed by heat waves.

The order from the acting chief justice follows numerous representations made by advocates and senior advocates, who highlighted the difficulties faced due to the extreme heat and humidity while adhering to the traditional dress code. Paritosh Sinha, secretary of the Incorporated Law Society, penned a letter to the acting chief justice, underscoring the hardships endured by lawyers wearing black robes and coats in the scorching weather.

In his letter, Sinha emphasized the struggles encountered by legal professionals amid the heat and humidity, urging for an exemption from the mandatory wearing of black robes and gowns in courtrooms. Notably, similar exemptions are reportedly practiced in other High Courts across the country, including the Delhi High Court and Rajasthan High Court, where summers are known to be intense.

The notification issued by the High Court registrar-general on Wednesday officially announced the directive from the acting chief justice, stating that advocates’ gown-wearing will be exempted until the court reconvenes after the summer vacation in June 2023. This decision reflects a responsive approach to the concerns raised by the legal community regarding the adverse effects of extreme weather conditions on their well-being and comfort.

By temporarily suspending the requirement for black gowns, the Calcutta High Court demonstrates a commitment to ensuring the welfare and convenience of lawyers while upholding the principles of justice and professionalism in courtroom proceedings.
