Delhi Court Rejects Default Bail Plea of Unitech’s Former Promoters in Money Laundering Case

A Delhi Court has denied default bail to Sanjay Chandra and Ajay Chandra, former promoters of Unitech, in a money laundering case related to the cheating of numerous homebuyers of substantial amounts.

The Enforcement Directorate initiated the case in 2018 following over 60 FIRs filed against the accused for various offenses, including cheating, criminal conspiracy, influencing public servants, and bribery.

In a recent order passed on April 12, Additional Sessions Judge Dheeraj Mor stated, “It is evident that the investigation concerning the applicants was completed within the statutory period of limitation, and therefore, the applicants are not entitled to the statutory right of default bail under Section 167(2) CrPC.”

Under the law, if an investigation isn’t concluded within the stipulated period from the date of the accused’s arrest, they have an indisputable statutory right to default bail.

The judge highlighted that sufficient evidence exists on record to proceed against the accused in the case, leading to the rejection of their default bail plea.

The decision marks a setback for the former promoters of Unitech as they continue to face legal challenges in connection with alleged financial irregularities and fraud involving multiple homebuyers.
