Delhi HC Waives Fine Imposed on Law Student Over ‘Extraordinary Interim Bail’ Plea for CM Kejriwal
The Delhi High Court has waived the ₹75,000 fine previously imposed on a law student who filed a plea seeking “extraordinary interim bail” for Chief Minister Arvind Kejriwal in connection with the alleged irregularities in the now-scrapped 2021-22 Delhi excise policy.
On Monday, a bench comprising Acting Chief Justice Manmohan and Justice Manmeet PS Arora acknowledged the petitioner’s unconditional apology and admitted mistake. The bench stated, “Today, the petitioner has tendered his unconditional apology. …the cost of ₹75,000 is waived off.”
The law student, who belongs to the lower middle class, sought the waiver on the grounds of his financial incapacity and expressed that he had learned his lesson after reading the court’s final judgment.
In April, the court had dismissed the student’s plea and imposed the fine, declaring the plea non-maintainable. The court pointed out that the petitioner had not challenged the judicial orders under which Kejriwal was in custody and emphasized that the court, in its writ jurisdiction, cannot grant “extraordinary interim bail” in pending cases against high office holders.
The Supreme Court had earlier, on May 10, granted Kejriwal a 21-day interim bail to campaign in the ongoing general elections. A week later, it reserved its verdict on Kejriwal’s plea challenging his arrest.
The Delhi High Court’s recent decision to waive the fine underscores the judicial system’s ability to reconsider decisions based on genuine remorse and financial considerations of the individuals involved.
