Delhi High Court Admits CBI’s Appeal Against A. Raja’s Acquittal in 2G Scam Case

The Delhi High Court has taken a significant step in the legal battle surrounding the infamous 2G spectrum allocation scam by admitting the Central Bureau of Investigation’s (CBI) appeal challenging the acquittal of former telecom minister A Raja, firms, and others involved in the case.

Justice Dinesh Kumar Sharma, presiding over the matter, declared that based on the material on record and the arguments presented by the lawyers representing the parties, the CBI has established a prima facie case that warrants further examination. Consequently, the appeal must be thoroughly heard.

“Leave to appeal is granted. List the appeal for hearing in May,” Justice Sharma stated.

The High Court’s decision to admit the appeal marks a pivotal moment in the legal proceedings, opening the path for a detailed examination of the CBI’s challenge against the trial court’s verdict.

The CBI had initially filed the appeal in 2018, seeking to challenge the acquittal handed down by the special court.

“Leave to appeal” is a procedural step wherein a court formally permits a party to contest a decision in a higher court.

Justice Sharma had reserved his decision on this matter during the hearing held on March 14.

In a significant ruling on December 21, 2017, the special court had acquitted A Raja, DMK MP Kanimozhi, and other accused individuals in both the CBI and Enforcement Directorate (ED) cases related to the 2G scam.

The admission of the CBI’s appeal by the Delhi High Court reignites the legal scrutiny over one of the most prominent corruption scandals in India’s telecommunications history, signaling a renewed phase of judicial review and deliberation.
