The Delhi High Court has dismissed Chief Minister Arvind Kejriwal’s plea challenging his arrest and subsequent remand by the Central Bureau of Investigation (CBI) in connection with the Delhi excise policy case. The ruling is a significant legal setback for the Aam Aadmi Party (AAP) leader, who has been in judicial custody since April 1.
Background of the Case:
Arvind Kejriwal, the Chief Minister of Delhi and the national convenor of the Aam Aadmi Party, was arrested by the CBI on June 23 on charges related to an alleged scam in the formulation and implementation of the Delhi excise policy. The CBI had sought five days of custody for further investigation into the matter. Kejriwal has been implicated in what authorities describe as a money laundering case linked to the controversial excise policy.
Court Proceedings:
Following his arrest, Kejriwal approached the Delhi High Court, challenging the legality of his arrest and the extension of his judicial custody. In his plea, Kejriwal argued that his arrest was politically motivated and driven by malafide intentions. His counsel contended that as the sitting Chief Minister of Delhi, he was being targeted by the central investigative agency for extraneous reasons.
However, Justice Neena Bansal Krishna, presiding over the case, dismissed the plea, stating that “it cannot be said that the arrest was without any justiciable reasons or illegal.” The court’s decision effectively upholds the actions taken by the CBI, reinforcing the legality of Kejriwal’s arrest and subsequent remand.
Extension of Judicial Custody:
On a related note, the Rouse Avenue Court, through special Judge Kaveri Baweja, extended Arvind Kejriwal’s judicial custody until August 8. The extension means that Kejriwal will continue to remain in Tihar Jail, where he has been held since his initial arrest.
Kejriwal had previously been granted interim bail by the Supreme Court for a period of 21 days to campaign for the upcoming Lok Sabha elections. However, after completing his campaign activities, he returned to prison on June 2.
Political and Legal Implications:
The dismissal of Kejriwal’s plea by the Delhi High Court adds another layer of complexity to the ongoing legal battle surrounding the excise policy case. As the leader of a prominent political party and the current Chief Minister of Delhi, Kejriwal’s continued incarceration could have significant ramifications both for the Aam Aadmi Party and the political landscape in Delhi.
The case has also drawn widespread attention due to the high-profile nature of the individuals involved and the serious allegations of corruption and money laundering.
Conclusion:
With the Delhi High Court’s rejection of Arvind Kejriwal’s plea, the legal challenges facing the Delhi Chief Minister appear far from over. As the case progresses, it will likely continue to be a focal point of public and political discourse in the coming months.
