“Delhi High Court Issues Temporary Injunction Against Punjab-Based Chain for Trademark Infringement on ‘DOMINO’S'”

The Delhi High Court has issued a temporary injunction against M/S MG Foods, a Punjab-based fast-food chain, for infringing on the trademark “DOMINO’S” owned by Domino’s IP Holder LLC and Jubilant Food Works Limited. The injunction was granted under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908. Justice Anish Dayal’s bench concluded that the plaintiffs, Domino’s IP Holder LLC and Jubilant Food Works Limited, have established a prima facie case for the grant of an ex-parte ad interim injunction. This means the Court is satisfied that Domino’s has a strong legal case to protect its trademark.

Background: Domino’s, a globally recognized brand established in 1965, argued that M/S MG Foods’ use of “DONITOS” violates their trademark rights and could mislead consumers. The infringement was discovered in April 2024 when Domino’s noticed a YouTube video linking their brand with “DONITOS.” M/S MG Foods not only operates stores in Punjab using the infringing mark but has also applied for the registration of “DONITO’S” as a trademark. Although the application has been accepted and advertised, Domino’s has reserved their right to object.

Court’s Findings: The Court noted that the use of “DONITOS” by M/S MG Foods is deceptively similar to the “DOMINO’S” trademark, creating a likelihood of consumer confusion. Justice Dayal emphasized that Domino’s would suffer “irreversible injury” if the injunction were not granted, considering their established brand reputation and the potential for consumer deception.

Order: The Court ordered the following:

  1. Ex-parte Ad Interim Injunction: M/S MG Foods is restrained from using “DONITOS” or any similar marks on any products, promotions, or signage.
  2. Removal from Social Media: M/S MG Foods must remove all “DONITOS” product listings from social media platforms.

A follow-up hearing for this case is scheduled to be held soon. This temporary injunction highlights the importance of protecting trademarks and the legal recourse available to businesses in case of infringement.
