Delhi High Court Seeks Response from NTA on NEET Candidate’s Petition Over ‘Out of Syllabus’ Question

The High Court of Delhi has sought a response from the National Testing Agency (NTA) regarding a petition filed by a NEET candidate alleging the presence of an ‘out of syllabus’ question in the entrance examination. The petitioner contends that a question in the physics section was based on the topic of ‘radioactivity,’ which was not included in this year’s NEET-UG syllabus.

Petitioner’s Claims

The petitioner, who claims to be a successful candidate, argues that his overall ranking was adversely affected due to the errors in the examination. He points out two major issues:

  1. Out of Syllabus Question: A question related to ‘radioactivity’ was included in the physics section, despite ‘radioactivity’ not being part of the NEET-UG syllabus for the year.
  2. Manifest Error: Another question had a “manifest error” where NTA declared the incorrect option as the correct answer.

Court’s Directions

A vacation bench of Justice Dharmesh Sharma has granted two weeks for the counsel representing the authorities—Centre, NTA, and National Medical Commission—to file their response to the petition.

“Learned counsels for respondents No.1 to 3 are present on advance notice & a request is made to grant time to file a short affidavit. Let the same be filed within two weeks from today,” stated the bench in the order passed on June 24.

Petitioner’s Concerns

The petitioner highlights the significance of addressing such errors in competitive exams, especially for examinations determining the future of medical professionals. The petition, filed through lawyer Sameer Kumar, emphasizes that irregularities in competitive exams perpetuate inequalities, favoring undeserving candidates while disadvantaging those whose future careers as doctors will impact public health.

“It is submitted that irregularities in competitive exams & that too where the examination is being held for preparing a host of future doctors, clearly deserves to be appreciated with utmost seriousness as it not only perpetuates inequalities by favoring the undeserving but while disadvantaging those in whose hands the health of the people of nations will rest in years to come,” the petition stated.

Next Hearing

The court has scheduled the next hearing for this matter on July 16, giving the authorities time to respond to the petitioner’s allegations.
