On Tuesday, the High Court of Delhi transferred the investigation into the death of Faizan, a 23-year-old Muslim man, to the Central Bureau of Investigation (CBI). Faizan was allegedly assaulted by policemen and forced to sing the national anthem and Vande Mataram during the north-east Delhi riots in February 2020.
Justice Anup Jairam Bhambhani presided over the bench that approved the transfer. The decision came in response to a plea filed by Kismatun, Faizan’s mother, who sought a probe by a court-monitored special investigation team into her son’s death.
“I am allowing the plea and transferring the investigation to the CBI,” stated Justice Bhambhani, indicating the court’s determination to ensure a thorough and impartial investigation.
Faizan’s tragic death occurred amidst the violent riots that rocked north-east Delhi in February 2020. According to the petition filed by Kismatun, Faizan, along with others, was brutally assaulted by police officers and coerced into singing patriotic songs. This incident, captured on video, quickly went viral, drawing widespread attention and condemnation.
Following the assault, Faizan was allegedly detained illegally by the police and deprived of essential medical care. He succumbed to his injuries on February 26, 2020, two days after the assault.
In her petition, Kismatun accused the police of not only perpetrating the assault but also failing to provide necessary medical assistance to her son, which she argued directly contributed to his death. She called for a comprehensive investigation by a specialized team, monitored by the court, to uncover the truth behind her son’s untimely demise.
The transfer of the investigation to the CBI signifies a significant step towards ensuring accountability and justice. Given the gravity of the allegations and the involvement of police officers, an independent and thorough investigation is crucial. The CBI, with its mandate and resources, is expected to conduct a fair and detailed inquiry into the circumstances leading to Faizan’s death.
