Gujarat High Court Orders Independent Visit to Morbi Bridge Collapse Victims for Ground Reality Check

On Tuesday, the High Court of Gujarat took a significant step towards understanding the true impact of the Morbi suspension bridge collapse by directing an amicus curiae and an independent lawyer to visit the victims on its behalf. This directive aims to gather a comprehensive understanding of the ground reality and ensure that the victims’ needs and issues are adequately addressed.

Background of the Tragedy

The tragic collapse of the British-era bridge over the Machchu River on October 30, 2022, resulted in the deaths of 135 individuals and injuries to 56 others. The incident has prompted a suo motu Public Interest Litigation (PIL) by the High Court to investigate the causes and consequences of the disaster.

Court’s Directive

During the hearing, a division bench led by Chief Justice Sunita Agarwal emphasized the need for an independent and thorough assessment of the victims’ conditions. The Chief Justice proposed that the amicus curiae, accompanied by another lawyer, should visit the victims to gather firsthand information and report back to the court. This approach aims to ensure that the court has an accurate and holistic understanding of the victims’ plight.

“We are proposing that someone should go and talk to the victims on behalf of the court. Amicus should visit the victims and talk to them, try to understand the ground reality and submit the report,” stated Chief Justice Agarwal. The directive included specific instructions for the lawyers to counsel any victims who have refused compensation and to ensure that the court’s efforts to assist them are well understood.

Logistical Support

The court has instructed that the visit should be scheduled in August, with logistical support provided by the district collector. This will facilitate the lawyers’ engagement with the victims and ensure a smooth and effective process.

Oreva Group’s Responsibility

Advocate General Kamal Trivedi informed the court that the Oreva Group, which was responsible for the bridge’s operation and maintenance, had formed a Trust to oversee the welfare of the victims. The Trust has committed to delegating members to visit the victims every three months to assess and address their needs. Special attention will be given to the seven children orphaned by the tragedy and the 14 other children who lost a parent. The chief district health officer will also be involved in the ongoing support efforts.
