The High Court of Allahabad has intervened by staying an order issued by the district magistrate of Hathras, which directed Deputy Collector Sanjay Kumar to assume the responsibilities of the executive officer of Nagar Palika Parishad.
In response to a petition filed by the Municipal Board of Nagar Palika Parishad, Hathras, Justice Prakash Padia issued the stay order on April 25. The court also instructed the state government and relevant authorities to furnish their responses to the case.
The petitioner contended that Sanjay Kumar cannot feasibly fulfill his duties as both deputy collector and executive officer simultaneously. Furthermore, it was argued that the district magistrate lacked the authority to appoint him as the executive officer of the Parishad, rendering the appointment unlawful.
In contrast, the additional advocate general representing the state government asserted that the appointment was made after due consideration of all relevant factors by the district magistrate, warranting no intervention by the court.
Following deliberation, the court deemed it appropriate to suspend Sanjay Kumar’s appointment as executive officer of Nagar Palika Parishad, Hathras. The case has been scheduled for further hearing after eight weeks.
This judicial intervention underscores the significance of adhering to legal protocols and ensuring the separation of duties in administrative appointments. The stay order provides relief to the Municipal Board of Nagar Palika Parishad, Hathras, pending further judicial review of the matter.
