Jharkhand HC: Abetment in Suicide Requires Active Instigation or Aid

In a recent judgment, the court quashed proceedings against a petitioner, highlighting the absence of evidence demonstrating direct or indirect incitement to suicide.

Case Background:

The petitioner sought to quash proceedings initiated by the learned Additional Chief Judicial Magistrate under Section 306 of the IPC. The allegations against the petitioner stemmed from an agreement between the co-accused and the deceased regarding land exchange, implicating the petitioner as the son of one of the co-accused.

Contentions:

The petitioner argued that the allegations lacked evidence of direct or indirect incitement to suicide. Citing legal precedent, the petitioner contended that mere association with the co-accused was insufficient to establish abetment under Section 306 of the IPC.

Court’s Observations:

The court emphasized that abetment under Section 306 of the IPC involves intentional and mental processes of instigating or aiding in the commission of suicide. A more active role, described as instigating or aiding in the commission of the act, is required before someone can be charged under Section 306. Relying on legal precedents, the court noted the absence of specific allegations against the petitioner apart from prior arrangements between the co-accused and the deceased.
