Litigant Found Guilty of Contempt for Scandalous Social Media Remarks Against Judges

Delhi High Court Holds Litigant Guilty of Contempt for Scandalous Social Media Remarks Against Judges

In a significant judgment, the Delhi High Court has initiated contempt proceedings against a litigant for posting a video on social media that contained scandalous remarks about judges. The litigant, involved in a land dispute over 2 bighas, was found guilty of undermining the dignity of the judiciary.

Judicial Decision

A division bench comprising Justice Suresh Kumar Kait and Justice Manoj Jain denied the respondent-contemnor’s claim that the petitioner had manipulated the content he posted on social media. The court held him guilty under the Contempt of Courts Act, 1971.

“The afore-noted expression and the video posted by him on social media show that the respondent has made contemptuous allegations against the judges of this court and has thereby lowered the dignity of the justice delivery system. Accordingly, we hereby hold him guilty under the Contempt of Courts Act, 1971,” the court observed in its order.

Petitioner’s Arguments

The petitioner argued that the respondent willfully interfered with the court’s work, obstructed the administration of justice, and scandalized and lowered the court’s authority. The video, according to the petitioner, specifically defamed the judges and alleged that it revealed the “true fate” of the courts to the public.

Court’s Stand

The court took a firm stand against the respondent’s actions, emphasizing that such behavior undermines public confidence in the judiciary and disrupts the administration of justice. The judges ruled that the video constituted a willful attack on the judiciary’s integrity.

Next Steps

The Delhi High Court has summoned the physical presence of the respondent-contemnor for the next hearing. The court will decide on the appropriate punishment under the Contempt of Courts Act, 1971.

Implications

This case underscores the judiciary’s intolerance towards any act that threatens its dignity and authority. It serves as a stern reminder to the public about the consequences of making unfounded allegations against judicial officers on social media.

Conclusion

The judgment highlights the importance of maintaining respect for the judiciary and upholding the integrity of the justice delivery system. It also signals the judiciary’s commitment to safeguarding its dignity against unwarranted attacks in the digital age.
