Madhya Pradesh HC Recognizes Forcing Spouse to Quit Job as Cruelty, Grants Divorce to Woman
In a landmark ruling, the Madhya Pradesh High Court overturned a family court decision and granted a woman’s plea for divorce, holding that compelling a spouse to quit their job or conform to the other’s preferences constitutes mental cruelty under the law.
The petitioner, a 33-year-old woman employed as a manager in a Central government undertaking, alleged that her husband persistently harassed her to quit her job and live with him in Bhopal. The couple, married since 2014, initially shared aspirations for career growth, but differences arose when the woman secured a government job in 2017, while her husband did not. Her refusal to abandon her career to align with her husband’s demands led to irreconcilable differences and her decision to seek a divorce.
After the family court dismissed her plea, the woman appealed to the Madhya Pradesh High Court, citing mental harassment and infringement on her personal autonomy as grounds for cruelty.
The division bench, comprising Chief Justice Suresh Kumar Kait and Justice Sushrut Arvind Dharmadhikari, delved into the principles of marital equality and individual freedom. The Court emphasized that mutual respect and personal autonomy are foundational to a marriage, and no spouse can impose life-altering decisions on the other.
