Madras High Court Judge Admits Mistake in Judgment, Calls for Reconsideration

During an event organized by the Madras Bar Association Academy and Rakesh Law Foundation, Justice N Anand Venkatesh of the Madras High Court made a candid admission, acknowledging a mistake in a judgment delivered six years ago and calling for its reconsideration.

Justice Venkatesh emphasized the importance of recognizing and rectifying errors, stating, “Real change comes when you realize that you have committed a mistake and are willing to correct it.”

Reflecting on his journey since his elevation as a high court judge on June 4, 2018, Justice Venkatesh shared his experience of working with Justice M M Sundresh, a Supreme Court judge, who encouraged him and provided opportunities to write numerous judgments.

The admission of error pertains to a judgment delivered in the Harsha Estate case against P Kalyana Chakravarthy on July 23, 2018. Justice Venkatesh explained that the judgment was made in the excitement of being a new judge, and upon reflection, he realized that certain aspects of the judgment required reconsideration.

The revelation of the mistake came after reading an article written by senior advocate R Parthasarathy on the issue and discussing it with advocate Sharath Chandran. Justice Venkatesh expressed gratitude for the insights provided by legal experts, which prompted him to revisit and reassess his previous judgment.

Justice Venkatesh’s candid acknowledgment underscores the importance of humility and continuous learning in the legal profession. It serves as a reminder of the judiciary’s commitment to upholding justice and ensuring that decisions are made with careful consideration and integrity.

As Justice Venkatesh advocates for the reconsideration of his past judgment, his transparency and willingness to admit and rectify mistakes set a positive example for the legal community. This episode highlights the ongoing pursuit of excellence and fairness within the judiciary, reaffirming its dedication to serving justice with integrity and accountability.
