NHRC Finds Negligence in Fatal Stray Dog Attack at AMU, Orders Compensation to Victim’s Family

In a recent development, the National Human Rights Commission (NHRC) of India has held the Government of Uttar Pradesh accountable for the fatal stray dog attack that occurred last year on the Aligarh Muslim University (AMU) campus. The NHRC has directed the state government to compensate the victim’s family with Rs. 7.5 lakh and has requested a compliance report within eight weeks.

NHRC’s Investigation and Findings

The NHRC took suo motu cognizance of the incident following a media report on April 17, 2023, highlighting the tragic event. Notices were issued to:

  • Chief Secretary, Government of Uttar Pradesh
  • Vice-Chancellor, Aligarh Muslim University
  • Commissioner, Aligarh Municipal Corporation

The purpose was to gather detailed reports and ascertain whether any relief had been provided to the next of kin (NoK) of the deceased.

Responses from Authorities: The authorities provided material on record but did not satisfactorily address the issue of negligence. AMU’s Registrar responded, claiming no instructions for compliance were received and denied any human rights violations or negligence on the university’s part.

NHRC’s Observations

The NHRC noted that the authorities appeared to be evading responsibility. It emphasized that public servants’ negligence leading to human rights violations must not deprive the victims of due benefits. Consequently, the NHRC confirmed the monetary relief of Rs. 7.5 lakh to be paid to the victim’s next of kin as initially proposed in its show cause notice.
