In a recent development, the National Human Rights Commission (NHRC) of India has held the Government of Uttar Pradesh accountable for the fatal stray dog attack that occurred last year on the Aligarh Muslim University (AMU) campus. The NHRC has directed the state government to compensate the victim’s family with Rs. 7.5 lakh and has requested a compliance report within eight weeks.
Victim: Safadr Ali Khan, 65 years old Incident: Mauled to death by stray dogs Location: Aligarh Muslim University campus Date: April 2023
The NHRC took suo motu cognizance of the incident following a media report on April 17, 2023, highlighting the tragic event. Notices were issued to:
The purpose was to gather detailed reports and ascertain whether any relief had been provided to the next of kin (NoK) of the deceased.
Responses from Authorities: The authorities provided material on record but did not satisfactorily address the issue of negligence. AMU’s Registrar responded, claiming no instructions for compliance were received and denied any human rights violations or negligence on the university’s part.
The NHRC noted that the authorities appeared to be evading responsibility. It emphasized that public servants’ negligence leading to human rights violations must not deprive the victims of due benefits. Consequently, the NHRC confirmed the monetary relief of Rs. 7.5 lakh to be paid to the victim’s next of kin as initially proposed in its show cause notice.
The unfortunate event occurred when Safadr Ali Khan was attacked by a pack of stray dogs during his morning walk in a park on the AMU campus. The incident received widespread attention, with a video of the attack going viral on social media.
The NHRC’s directive underscores the importance of accountability and prompt action by public authorities to prevent such tragic incidents. The Commission has stressed the necessity for the Uttar Pradesh Government to comply with the order and submit proof of payment within the stipulated time frame.
This ruling sets a precedent for handling cases of negligence by public authorities leading to human rights violations. It also highlights the critical need for better management of stray animal populations in public areas to ensure the safety and security of residents.
