On Tuesday, the Patna High Court quashed an FIR lodged against Sanjiv Hans, a senior IAS officer of the Bihar cadre, who had been accused of rape by a woman. The court’s decision came as a significant relief to Hans, who had been facing serious allegations that had tarnished his professional reputation.
Justice Sandeep Kumar, presiding over the case, passed the order in favor of Hans, allowing his petition that challenged the FIR filed at Rupaspur police station last year. The complainant, a lawyer from Aurangabad district who practices at the Allahabad High Court, had accused Hans and his alleged collaborator, Gulab Yadav, a former RJD MLA, of raping her.
The FIR was lodged based on the woman’s allegations that she had been sexually exploited by the duo under the false pretense of being assisted in securing a position on the State Women’s Commission. The case gained additional attention recently when the Enforcement Directorate (ED) conducted raids on the premises of both Hans and Yadav in connection with a separate money laundering investigation. Hans had been stripped of his influential position in the power department, and Yadav was noted to be in a state of political decline.
In his ruling, Justice Kumar observed that “no offence is made out against the petitioner,” and described the “story propounded by the complainant” as “false and fabricated.” The court noted that the FIR was lodged “after much delay,” further casting doubt on the credibility of the allegations.
The court’s decision brings an end to the legal turmoil for Sanjiv Hans, though the broader implications of the allegations and subsequent investigations remain a topic of public interest.
