In a rare and amusing turn of events, the Punjab and Haryana High Court found itself entertained by the bizarre circumstances surrounding a bail application filed for a client who had passed away a month prior to the petition’s submission.
During the proceedings, Justice Manjari Nehru Kaul, presiding over the single-judge bench, couldn’t help but express her amusement at the legal theatrics unfolding before her. With a touch of wit and humor, she remarked that the counsel for the petitioner had managed to create quite the legal spectacle, even surpassing the feats of the renowned magician, Houdini.
The absurdity reached new heights when the state counsel presented the death certificate of the petitioner, confirming his demise a month earlier. Despite this irrefutable evidence, the petitioner’s counsel had brazenly filed the bail petition on behalf of his deceased client, complete with a posthumous Power of Attorney and an affidavit bearing the signature of the departed.
“It’s as if the petitioner was orchestrating the ultimate legal prank from beyond the grave,” quipped Justice Kaul, eliciting chuckles from the courtroom. She lightheartedly cautioned the counsel to exercise more prudence in his future legal endeavors, lest they inadvertently summon more ghostly clients or find themselves entangled in a legal quagmire of supernatural proportions.
However, amidst the jest and banter, the judge did issue a stern warning to the counsel, advising him to refrain from engaging in such “otherworldly activities” in the future, emphasizing the need to uphold the integrity of the legal profession.
Recognizing the counsel’s relative inexperience in the legal field, the court chose to show leniency and accepted his unconditional apology. With a final flourish of humor, Justice Kaul dismissed the petition with jesting remarks, reminding all present that the courtroom can be wild enough without invoking spirits from beyond the grave.
The incident served as a refreshing break from the routine courtroom proceedings, injecting some much-needed levity into an otherwise dull day in court.
