Supreme Court Orders Immediate Deportation of 17 Foreigners Languishing in Assam Detention Center

In a significant development, the Supreme Court has directed the Union of India to take immediate steps to deport 17 foreigners who are currently held in a detention center in Assam. The court’s directive came after it was revealed that these individuals, declared as foreigners, have no registered offences against them.

A bench comprising Justice Abhay S Oka and Justice Ujjal Bhuyan took cognizance of a report submitted by the State Legal Services Authority, which highlighted the plight of these detainees. Expressing concern over the prolonged detention of individuals without any registered offences, the bench emphasized the urgent need for their deportation.

The Supreme Court’s intervention follows its previous directive in April, where it instructed the State Legal Services Authority of Assam to provide information about individuals detained in detention centers for more than two years. Additionally, the court had tasked the legal services authority with assessing the facilities available to detainees in these centers.

The court’s decision underscores its commitment to protecting the rights of individuals detained in such centers, particularly those who have been held for extended periods. The directive for immediate deportation reflects the court’s stance on ensuring swift action to address issues related to detention without valid charges.

The plea before the Supreme Court sought the release of individuals who have been detained in Assam’s detention centers for more than two years. With this latest directive, the court has taken a significant step towards addressing the concerns raised regarding prolonged detention and ensuring the timely resolution of such cases.
