Supreme Court Quashes Obscenity Case Against The Viral Fever (TVF)

The Supreme Court has dismissed a criminal case filed against The Viral Fever (TVF) production company regarding alleged obscenity in its web series “College Romance.” Justices AS Bopanna and PS Narasimha ruled that no violation of the Information Technology Act was evident, thus quashing the First Information Report (FIR) against the show’s director, writers, and actors.

  1. Quashed Case: The bench dismissed the FIR against TVF and its team, stating that no violation of Sections 67 and 67A of the Information Technology Act was established.
  2. Appeal Success: TVF appealed against a Delhi High Court judgment from March 2023, which had ruled the web series’ language as obscene. The Supreme Court overturned this verdict.
  3. High Court Ruling: The Delhi High Court previously held TVF, director Simarpreet Singh, and actor Apoorva Arora liable under IT Act Sections 67 and 67A, citing obscenity concerns.
  4. Indian Context: The High Court emphasized judging morality and values in an Indian context, urging stricter enforcement of IT rules to uphold contemporary standards of civility.
  5. Legal Representation: Senior advocates and legal teams, instructed by Naik Naik & Co., represented TVF and its affiliates during the hearings before the Supreme Court.
  6. Delhi Police Involvement: Additional Solicitor General KM Nataraj, along with advocates, represented the Delhi Police in the matter.
