Supreme Court Questions Centre on States’ Regulatory Powers Over Industrial Alcohol

In a significant development, the Supreme Court raised questions regarding the regulatory powers of states over industrial alcohol, highlighting their role in safeguarding public health. The Apex Court, led by Chief Justice of India Dhananjaya Y Chandrachud, expressed concerns over hooch tragedies and emphasized the states’ authority to regulate such substances.

The nine-judge Constitution bench, comprising a panel of distinguished justices, is currently scrutinizing the overlapping jurisdiction between the Centre and states in the production, manufacturing, supply, and regulation of industrial alcohol. The bench’s inquiry delves into the complex dynamics of governance and legislative authority in this domain.

During the proceedings, the bench raised pertinent queries regarding the rationale behind denying states the power to regulate industrial alcohol, especially considering their responsibility as custodians of public health. The solicitor general, representing the Centre, defended the central government’s authority under the Industries (Development & Regulation) Act (IDRA), 1951, arguing that legislative control over industrial alcohol falls within the purview of the Union.

The solicitor general further emphasized the Parliament’s prerogative to control industries nationwide and regulate economic factors on a pan-India scale. He underscored the need for a cohesive regulatory framework governed by national interests rather than fragmented regulations dictated by provincial concerns.

The hearing, while inconclusive, sheds light on the intricate legal and policy considerations surrounding the regulation of industrial alcohol. The bench’s examination of past judgments and legislative provisions aims to reconcile conflicting interpretations and provide clarity on the respective roles of the Centre and states in this crucial domain.

The Supreme Court’s deliberations underscore the gravity of the issue and the need for a nuanced approach to regulatory governance. The upcoming sessions promise further insights into this complex legal terrain, with implications for public health, industry, and governance at large.
