In a significant development, the Supreme Court has intervened in the conviction and sentencing of Tamil Nadu Higher Education Minister K Ponmudi and his wife P.l Visalakshi in a disproportionate assets case. A bench comprising Justices Abhay S Oka and Ujjal Bhuyan has granted a stay on the conviction and three-year sentence imposed on the minister and suspended the sentence of his wife as well.
Represented by senior advocate Sidharth Luthra, the minister and his wife received relief from the apex court after it exempted them from surrendering in the matter earlier this year. This decision comes after the Madras High Court had sentenced both Ponmudi and Visalatchi to three years of simple imprisonment in December last year, marking a historic event as the first time a sitting Minister from the DMK party has been convicted and sentenced in a disproportionate assets case.
The conviction had immediate consequences for Ponmudi, facing disqualification under Section 8(1) of the People’s Representation Act, 1951. However, with the suspension of their sentence by the high court, they were permitted to approach the Supreme Court for further appeal. Both individuals, aged 72, submitted their medical records in support of their appeal for a reduced punishment.
The Supreme Court’s decision to stay the conviction and sentence underscores the importance of due process and fair legal proceedings, providing an opportunity for further review and potential reconsideration of the case. This development will likely have significant implications for both the individuals involved and the broader political landscape in Tamil Nadu.
