In a poignant display of empathy, the Supreme Court advocated for the release of a 96-year-old terror convict, Habib Ahmed Khan, who has been serving a life sentence in connection with the 1993 train blast case in Rajasthan. The court, recognizing the frail health and advanced age of Khan, emphasized that his continued incarceration amounted to a form of capital punishment.
Khan, who has spent 27 years in jail, has been granted parole thrice due to his deteriorating health condition. Seeking permanent parole, he approached the Supreme Court, citing his poor health and advanced age as compelling reasons for release.
The bench, comprising Justices Abhay S Oka and Ujjal Bhuyan, urged the Rajasthan government to reconsider Khan’s case from a human rights perspective, highlighting that his prolonged imprisonment served no meaningful purpose. The court, while acknowledging Khan’s past conviction under the Terrorist and Disruptive Activities (Prevention) Act (TADA), stressed that his age and health condition warranted compassionate consideration.
Expressing concern over Khan’s medical report and describing his situation as dire, the bench underscored the need for sensitivity in administering justice. It emphasized that at 96 years old, Khan is essentially “counting his days,” and prolonged incarceration under such circumstances lacked compassion.
The bench further directed the Rajasthan government to explore options such as remission or permanent parole for Khan, signaling a departure from strict legal formalities in favor of humanitarian considerations. The matter has been scheduled for further deliberation after two weeks.
Khan’s case underscores the complex intersection of justice, compassion, and legal rigidity. While his conviction under TADA remains, the Supreme Court’s intervention reflects a recognition of the unique circumstances surrounding his case and the need for a humane approach to sentencing.
As the legal proceedings unfold, Khan’s case serves as a poignant reminder of the importance of compassion and empathy in administering justice, especially towards individuals facing significant health challenges in the twilight years of their lives.
Key Points:
The Supreme Court’s intervention underscores the importance of balancing legal principles with compassion and empathy, particularly in cases involving vulnerable individuals facing significant health challenges.
