The Supreme Court has urged the Delhi High Court to expedite its decision on the bail plea of Sharjeel Imam, who has been detained under the Unlawful Activities (Prevention) Act (UAPA) in connection with the 2020 Delhi riots. The Supreme Court’s request came as it declined to directly entertain Imam’s Article 32 petition for bail, directing the matter back to the Delhi High Court where the bail plea has been pending since April 2022.
The bench, comprising Justices Bela Trivedi and Satish Chandra Sharma, noted that Imam’s petition had been listed over 60 times before various benches. Senior advocate Siddhartha Dave, representing Imam, highlighted the prolonged delay in the High Court’s proceedings, with the last request for an early hearing dismissed in September.
Imam, who was arrested in 2020 and designated as a primary conspirator in the Delhi riots case by the Delhi police, continues to face charges under the stringent UAPA. The Supreme Court’s directive to the Delhi High Court underscores the importance of timely judicial consideration in cases involving prolonged detentions under anti-terrorism laws.
