“Supreme Court’s Growing Role in Bail Matters: Justice Bela Trivedi’s Concerns”

Justice Bela Trivedi, a member of the Supreme Court’s vacation bench, has voiced her apprehensions regarding the increasing influx of bail matters reaching the apex court. Expressing her concerns, Justice Trivedi remarked that the Supreme Court should refrain from interfering in bail matters, suggesting that such issues should be conclusively resolved at the High Court level. She went further to lament, “Supreme Court has become a bail court.”

The remarks come amidst a growing trend of bail matters being brought before the Supreme Court routinely, raising questions about the allocation of the court’s time and resources. During a recent hearing, the bench, which also comprised Justice Pankaj Mittal, heard arguments in a bail matter presented by Senior Advocates Mukul Rohtagi and Sidharth Luthra.

Justice Trivedi’s stance underscores the need for a more streamlined approach to the adjudication of bail matters, with a preference for resolution at the High Court level. While the Supreme Court serves as the final appellate authority, its intervention in bail matters may lead to an unnecessary burden on the court and delay in the dispensation of justice.

The issue raises broader questions about the role and function of the Supreme Court, particularly in light of its increasing workload and the need to prioritize cases of national importance. As the apex court grapples with a plethora of legal challenges, Justice Trivedi’s concerns serve as a timely reminder of the importance of judicial efficiency and the need for a judicious allocation of resources.
