Uttarakhand High Court Seeks Advocates’ Opinion on Court Relocation, Prioritizing Environment

In a notable development, the division bench of the Uttarakhand High Court, led by Chief Justice Ritu Bahri and Justice Rakesh Thapliyal, has taken a proactive stance on the relocation of the High Court to IDPL Rishikesh. The bench emphasized the importance of environmental preservation while addressing this significant move.

Two days after presenting their stance on the relocation, the bench directed the registrar general to establish a portal to gather opinions from lawyers and litigants regarding the transfer. Practising lawyers can express their preference by selecting ‘YES’ or ‘NO,’ while litigants have the option to cast their votes by providing their Aadhar card number. The deadline for submitting preferences has been set for May 31, with no extensions permitted.

Additionally, the division bench highlighted the Supreme Court’s directive to preserve forests during the relocation process. A 26-hectare plot with 75% tree coverage at Golapar in Haldwani has been proposed for the new High Court, with a commitment to avoid tree felling for construction purposes.

The High Court further mandated the identification of suitable land for residential quarters for judges, judicial officers, and staff, along with courtrooms, a conference hall, lawyer chambers, a canteen, and parking facilities, all with access to medical services and connectivity. This process is to be completed within a month, with a report due by June 7. The Court also welcomed suggestions from the high court Bar Association regarding suitable land for the court’s relocation.

A committee, chaired by the registrar general and comprising officials from legislative and parliamentary affairs, home affairs, senior advocates, and members nominated by the Uttarakhand Bar Council of India, will submit its report by June 7. The government’s recommendation on suitable land and the outcome of preferences will then be presented before the Chief Justice.

Meanwhile, Advocate Rajiv Sharma, president of the association, expressed support for the relocation, citing convenience for litigants and future expansion of the court. The unanimous decision reflects a collective effort to ensure the best interests of all stakeholders involved.
